Volodymyr Zelensky signed decrees №358/2019 and 359/2019 revoking the decrees on the appointment of members of the Supreme Council of Justice, despite the fact that Articles 24 and 25 of the law of Ukraine ‘On the Supreme Council of Justice’ establish exclusive lists of grounds for dismissal and termination of its members.

Among these grounds, in both cases, there is no such a reason as ‘revoking of the decree appointing a member of the SCJ’.

Article 19 of the Constitution of Ukraine provides that public authorities have to act only within the powers and in the manner prescribed by the Constitution and laws of Ukraine.

 

Given the above, the repeal by Zelensky of the earlier presidential decrees is a violation of the Constitution of Ukraine and the law of Ukraine ‘On the Supreme Council of Justice’.
